2. Project Cancellation by Client
If a client chooses to cancel a project or service agreement after work has commenced but before completion, the following may apply:
- Upfront Deposits/Initial Payments: Any initial deposits or upfront payments made to commence work are typically non-refundable, as they cover initial setup, planning, resource allocation, and preliminary work.
- Work Performed: The client will be invoiced for all work performed up to the date of cancellation, based on the agreed-upon hourly rates or a pro-rata basis of the project milestones completed. Any amount paid in excess of the work performed will be refunded, and any outstanding balance will be due immediately.
- Custom Agreements: Specific cancellation clauses and refund terms for larger projects will be detailed in the individual Service Agreement (SOW) or proposal signed by both parties. These project-specific terms will supersede this general policy.
3. Service Issues and Dissatisfaction

- Resolution First: Our primary goal is to resolve any issues through revisions, adjustments, or additional work as necessary, according to the scope defined in the Service Agreement.

- Mutual Agreement: Refunds or partial refunds, if granted, will only be issued upon mutual agreement between Apex Byte and the client, taking into consideration the extent of work completed, resources utilized, and the nature of the dissatisfaction.
4. Exceptions and Specific Cases
- Failure to Deliver: In the unlikely event that Apex Byte is unable to deliver the agreed-upon services as outlined in the Service Agreement, a refund or partial refund proportionate to the undelivered portion of the service may be considered.
- Pre-Payment for Future Services: If you have made a pre-payment for services that have not yet commenced, you may be eligible for a full or partial refund, depending on the terms specified in your Service Agreement and any administrative costs incurred.
